Need proof of UK tax residence?
Need proof of UK tax residence? HMRC has updated its guidance to help you apply. The guidance covers both individuals and organisations. Specifically, it explains how to apply for a certificate of residence or a letter of confirmation. As a result, taxpayers and their advisers should now find the process clearer.
What is a certificate of residence?
A certificate of residence helps UK residents who pay tax on foreign income. In particular, it lets them claim tax relief in another country. The certificate confirms to the overseas tax authority that the applicant is UK resident.
However, HMRC can only issue a certificate when both of these conditions apply:
- the UK has a double taxation agreement with the country concerned
- the applicant is entitled to treaty benefits.
When might a letter of confirmation suit you better?
Sometimes, a certificate isn’t the right option. For example, the UK may not have a double taxation agreement with the relevant country. Alternatively, you may need proof of UK residence for another purpose. In these cases, a letter of confirmation may be more appropriate. Either way, the overseas tax authority decides whether to grant relief from foreign tax.
Who can use the online service?
HMRC’s online service is open to a wide range of applicants, including:
- individuals and sole traders
- companies
- partnerships
- trusts
- charities
- public bodies
- pension schemes
- collective investment schemes.
In addition, agents can apply directly on behalf of taxpayers. This makes things easier for anyone who already uses an adviser.
What details do you need to provide?
Before you apply, it’s worth gathering the right information. Applicants need to provide details such as:
- the country they need the certificate for
- the relevant double taxation agreement
- the type of income
- the period the certificate covers.
Note, however, that you can’t request a future date.
What if you haven’t filed your tax return yet?
If you haven’t filed a tax return yet, HMRC asks for further information. For instance, you must state how many days you spent in the UK. You need to do this for each tax year the certificate covers. Therefore, accurate travel records can make the whole process much smoother.
